Avoiding Immigration Fraud
Immigration fraud is a serious problem that preys on the hopes of people seeking a better life. This guide helps you recognize the warning signs and protect yourself.
The Golden Rule
No legitimate service can guarantee a U.S. visa, Green Card, or employment.
The U.S. immigration system is government-controlled. No private company, agency, or individual can guarantee an outcome. Anyone who promises guaranteed approval is being dishonest.
Common Scams
1. The "Guaranteed Visa" Promise
- Claim: "We guarantee you will get a U.S. visa/Green Card"
- Reality: No one can guarantee this. U.S. immigration decisions are made by government officials based on individual cases
- Red flag: Any guarantee of approval
2. Fake Job Offers
- Claim: Pay upfront for a "guaranteed job" in the U.S.
- Reality: Legitimate EB-3 employment requires a real employer, PERM certification, and an approved petition β a process that takes months, not days
- Red flag: Job offers that require large upfront payments
3. Upfront Fee Demands
- Claim: "Pay now or lose your spot"
- Reality: Legitimate processes have clear, documented fee structures. High-pressure tactics are a manipulation strategy
- Red flag: Urgency, secrecy, or demands for cash payments
4. Fake Attorneys or Consultants
- Claim: Someone claims to be an immigration attorney or government official
- Reality: You can verify attorneys through state bar associations and check USCIS-accredited representatives
- Red flag: Refusal to provide credentials or references
5. Phishing and Identity Theft
- Claim: Emails or messages asking for personal information, passport copies, or payment "from USCIS"
- Reality: USCIS communicates by mail, not email. Official U.S. government websites end in .gov
- Red flag: Any .com site claiming to be the official U.S. government
Warning Signs Checklist
Be suspicious if anyone:
- β Promises or guarantees visa approval
- β Demands large upfront cash payments
- β Uses high-pressure sales tactics ("limited time only")
- β Cannot provide a physical office address
- β Refuses to put terms in writing
- β Claims "special connections" with U.S. immigration
- β Asks you to lie on applications
- β Offers to "buy" a U.S. passport or Green Card
- β Asks for your password to government portals
- β Communicates only through WhatsApp or personal email (no official channels)
How to Protect Yourself
Verify Everything
- Check .gov websites β official U.S. government sites end in .gov (e.g., uscis.gov, travel.state.gov)
- Verify attorneys through your state's bar association website
- Research companies β look for reviews, registrations, and physical addresses
- Ask for written contracts β never pay without a documented agreement
Use Official Resources
- USCIS (uscis.gov) β official immigration forms and information
- Department of State (travel.state.gov) β visa information
- Department of Labor (dol.gov) β labor certification information
- Federal Trade Commission (ftc.gov) β report fraud
Keep Records
- Save all emails, messages, and contracts
- Get receipts for all payments
- Take notes during conversations
- Never hand over original documents without a receipt
If You've Been Scammed
- Stop all communication with the suspected fraudster
- Report to the FTC at ReportFraud.ftc.gov
- Report to U.S. immigration authorities if the fraud involves immigration services
- Contact your local law enforcement
- Notify your bank if you've made payments
- Place a fraud alert on your credit if identity theft is involved
